INTRODUCTION:
spillyerbeans.com is offering Ugliest Shoe/s Photo Contest. NO PURCHASE IS NECESSARY. VOID WHERE PROHIBITED. By entering this Contest, entrants agree to abide by all terms of these Official Contest Rules and the decisions of spillyerbeans.com shall be final and binding.

ELIGIBILITY:
Limit of one (1) entry per email address at spillyerbeans.com. This Contest is open only to individuals who are eighteen (18) or older. Entrants must be legal residents of the United States at the time of entry.

HOW TO ENTER:
To enter, submit photo of your ugliest shoe/s to http://www.spillyerbeans.com/rankratev4/index.php. Contest begins at 11:59 p.m. ET on Monday, January 07, 2007 and ends on March 01, 2007 11:59 p.m. ET. All online entries must be received by 11:59 p.m. ET on March 01, 2007 to be eligible. No responsibility is assumed by spillyerbeans.com for lost, late or misdirected entries or for any computer, online, telephone or technical malfunctions that may occur. Entries will be deemed submitted by the authorized account holder of the email address through which the entry was submitted. "Authorized account holder" is defined as the person who is assigned to an email address by an Internet Access provider, online service provider, or other organization (including, without limitation, a business or educational institution) that is responsible for assigning email addresses. All entries become the property of spillyerbeans.com and will not be returned to entrants.

TERMS:
By entering the Contest you agree to the following terms and conditions.
The photo you submit is an original photo that you took and own all the rights to.
The photo that you submit has not been copied from a third party source.
You agree that under no circumstances shall Spillyerbeans.com be liable for any negligence not limited to copyright infringement, direct, indirect, incidental or consequential damages of any kind arising from your submission of a photo to the Ugliest Shoe/s Photo Contest at Spillyerbeans.com
By submitting photo to Spillyerbeans.com you grant Spillyerbeans.com permission to display photo for the duration of the Contest and thereafter if Spillyerbeans.com so chooses.

WINNER SELECTION:
Winning photo will be selected by random drawing from top 20 entries (the top 10 gals shoes and top 10 guys shoes will be pooled together for the top 20 entries) on March 01, 2007. Odds of winning depend on the number of votes and eligible entries received. Winner’s name will be posted at spillyerbeans.com on or about March 03, 2007.

PRIZE:
$25.00 Prize is non-transferable. No substitution, except that spillyerbeans.com, in its sole discretion, reserves the right to change or replace prize at any time with prize of greater or comparable value. The value of prize may be taxable as income. Prize winner is solely responsible for all applicable federal, state and local taxes that become due.

WINNER NOTIFICATION:
spillyerbeans.com will attempt to notify prospective winner by email on or about March 03, 2007. If potential winner cannot be contacted within 5 days of the first attempted contact, or if eligibility requirements are not met, a prospective winner may be deemed ineligible, and an alternative prospective winner will be selected at random from all eligible entries received. This winner selection process will continue until a winner is determined. Prize winner may be required to complete, sign and return Affidavits of Eligibility, Waivers of Liability and Publicity Releases. Failure to comply with these Official Contest Rules or to claim a prize may result in disqualification of a prospective winner.

This Contest is subject to all federal, state and local laws, rules and regulations. Entrants grant to spillyerbeans.com to use and publish their submitted photo, proper name, city and state online and in print or any other media, in connection with the Contest. Acceptance of a prize constitutes permission for spillyerbeans.com to use winners' name and likeness for advertising and promotional purposes without additional compensation unless prohibited by law. spillyerbeans.com is not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed transmissions which may limit an entrant's ability to participate in the Contest or damage entrant’s system as a result of participation in the Contest or downloading any information necessary to participate in the Contest. Spillyerbeans.com is not responsible for misdirected, lost, late, illegible, forged, destroyed, or incomplete entries, or entries not otherwise in compliance with these Official Contest Rules. By entering this Contest, each entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or in connection with the Contest or any prize awarded, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs, associated with entering the Contest, but in no event will attorneys' fees be awarded or recoverable; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to, punitive, incidental or consequential damages and/or any other damages other than actual out-of-pocket expenses.Each winner, by accepting a prize, agrees to release and hold harmless spillyerbeans.com from any and all liability, claims or actions of any kind whatsoever, which may result from the receipt, enjoyment, ownership or use or misuse of such prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the entrant's rights of publicity or privacy, or the entrant's claim that he/she has somehow been defamed or portrayed in a false light.
